Terms of Use

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Services. If you use Brawlnest on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.

2. Use of the Services

Desoline Inc. grants you a limited, non-exclusive, non-transferable, and revocable right to access and use the Services in accordance with these Terms.

You agree not to misuse the Services, interfere with their operation, attempt unauthorized access, introduce malware or harmful code, circumvent security measures, use automated systems in a manner that disrupts the Services, or use Brawlnest for unlawful or fraudulent purposes.

3. Software

The Brawlnest game for Android is licensed to you under the End User License Agreement, which governs its download, installation, and use.

Unless permitted by applicable law, you may not copy, sell, sublicense, redistribute, reverse engineer, modify, or exploit Brawlnest software except as expressly authorized by us.

4. Distribution

The Brawlnest Android application is distributed as a direct download (APK file) from brawlnest.net. It is not distributed through Google Play or any other app store, and copies of Brawlnest are not obtained through Google Play.

Download Brawlnest only from brawlnest.net. Desoline is not responsible for copies obtained from any other source, which may be modified or unsafe. You can confirm a download is genuine by comparing its SHA-256 checksum with the one published on the download page.

Installing an app from outside an app store requires you to allow your browser or file manager to install unknown apps on your device. You choose whether to enable that setting, and you can turn it off again after installing Brawlnest.

Desoline is solely responsible for Brawlnest and for providing support for it.

5. Intellectual Property

Brawlnest and its software, website, characters, artwork, designs, graphics, music, sound effects, logos, trademarks, text, and other proprietary content are owned by Desoline Inc. or its licensors and are protected by applicable intellectual-property laws.

These Terms do not transfer ownership of any Brawlnest intellectual property to you.

6. Third-Party Services

Brawlnest may integrate with or provide links to third-party products and services.

Brawlnest for Android includes an optional service from Massive (joinmassive.com) that shares a small portion of your device's bandwidth and IP address in exchange for a one-time in-game coin bonus. It runs only if you accept it in the game, you can switch it off at any time in Settings, and your use of it is governed by Massive's terms and privacy policy. See our Privacy Policy.

We do not control third-party services and are not responsible for their availability, content, policies, or practices. Your use of third-party services may be governed by separate terms and privacy policies.

7. Update Emails

If you sign up on brawlnest.net for update emails, we will use your email address only to tell you about new versions of Brawlnest, as described in our Privacy Policy. You can ask us to remove it at any time.

8. Updates and Changes

We may modify, update, suspend, discontinue, or replace features of Brawlnest from time to time.

We may also release software updates, bug fixes, security updates, and new versions.

9. Suspension and Termination

We may suspend or terminate access to the Services when reasonably necessary, including in cases of violation of these Terms, suspected fraud or abuse, security risks, legal requirements, or conduct that may harm Brawlnest, its infrastructure, or other users.

You may stop using Brawlnest at any time.

10. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Brawlnest is provided on an "as is" and "as available" basis.

We do not guarantee that the Services will always be uninterrupted, error-free, secure, or available, or that all defects will be corrected.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Desoline Inc. and its owners, affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the Services.

Any limitations in these Terms apply only to the extent permitted by applicable law and do not limit rights or liabilities that legally cannot be excluded.

12. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Desoline Inc. from claims, damages, losses, and reasonable expenses arising from your unlawful use of the Services or material violation of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on brawlnest.net with a revised "Last updated" date.

Where required by law, we will provide additional notice or obtain consent before material changes take effect.

14. Governing Law

These Terms are governed by the laws of the State of Israel, without prejudice to mandatory consumer protections that may apply in your country of residence.

Any disputes will be subject to the jurisdiction of the competent courts of Tel Aviv-Yaffo, Israel, except where applicable consumer law provides otherwise.
